Terms & Conditions

1. About us and these terms

1.1 This website, hipadel.co.uk (the “Website”), is operated by Hi Padel Sport Limited (“Hi Padel”, “we”, “us” or “our”). We are a company registered in England and Wales under company number 16457573, with our registered office at 124 City Road, London, EC1V 2NX, United Kingdom.

1.2 These terms and conditions (the “Terms”) set out the rules for using the Website. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1.3 These Terms govern use of the Website only. Any partnership with a school, investment in Hi Padel, or use of a Hi Padel club or court will be covered by a separate written agreement, which will take priority over these Terms if there is any conflict.

1.4 You can contact us at hello@hipadel.co.uk.

2. Using our website

2.1 The Website is made available free of charge. We do not guarantee that it, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or change any part of the Website without notice.

2.2 You must use the Website lawfully and must not:

  • Use it in any way that breaches applicable law or regulation, or is fraudulent or harmful.

  • Attempt to gain unauthorised access to the Website, the server it is stored on, or any connected system.

  • Introduce viruses, malware or other harmful material, or carry out a denial-of-service attack.

  • Copy, scrape or extract content from the Website by automated means, except as permitted by law.

  • Submit false, misleading or offensive information through any form on the Website.

2.3 You are responsible for making your own arrangements to access the Website and for ensuring your device is protected against viruses.

3. Information on the website

3.1 Content on the Website, including information about our partnership model, court builds, revenue sharing, statistics about padel, and articles in our Insights section, is provided for general information only.

3.2 Nothing on the Website is an offer, a binding proposal or professional advice (including legal, financial, planning, safeguarding or tax advice). Any arrangement between Hi Padel and a school or other organisation is subject to site assessment, contract and any necessary approvals, and only becomes binding when a written agreement is signed.

3.3 Figures, timescales and examples (such as industry statistics, partner installation numbers or illustrative revenue models) may be estimates or based on third-party sources. We take reasonable care to keep the Website accurate and up to date, but we make no guarantee that it is complete, accurate or current.

3.4 Our guidance on how to play padel is general in nature. Padel is a physical sport; anyone taking part should play within their own ability and seek medical advice if they have any concerns about their fitness to play.

4. Investor information

4.1 The Investors section of the Website gives general background on Hi Padel and its business model. It does not constitute an offer to sell, or an invitation to subscribe for or buy, any shares, securities or other investment, and it is not an invitation or inducement to engage in investment activity.

4.2 The Website has not been approved by an authorised person for the purposes of section 21 of the Financial Services and Markets Act 2000. Any investment opportunity will only be made available to eligible investors, through separate documentation and in compliance with applicable law.

4.3 Investing in an early-stage business carries risk, including the risk of losing all of your investment. Past performance and projections are not a reliable indicator of future results. You should take independent financial advice before making any investment decision.

5. Enquiries and information you submit

5.1 When you submit an enquiry or partnership form, you confirm that the information you provide is accurate and that you are authorised to provide it, including on behalf of any school, trust or organisation you represent.

5.2 If you upload images, plans or other files (for example, photographs of a potential site), you confirm that you own them or have permission to share them, and that they do not include images of pupils or other identifiable individuals without the necessary consent. You grant us a non-exclusive, royalty-free licence to use that material to assess and respond to your enquiry.

5.3 Submitting an enquiry does not create any obligation on you or on us. We will aim to respond promptly but cannot guarantee a response time.

5.4 You must not submit material that is unlawful, defamatory, infringes anyone else’s rights, or contains confidential information you are not entitled to share. We may delete any submission that breaches these Terms.

6. Intellectual property

6.1 We, or our licensors, own all intellectual property rights in the Website and its content, including the Hi Padel name and logo, text, graphics, illustrations, photography, video and the design and layout of the Website. All such rights are reserved.

6.2 You may view the Website and print or download extracts for your own personal or internal organisational use, such as sharing information about a potential partnership with colleagues or governors. You must not modify any material, use any illustrations, photographs or video separately from accompanying text, or use any of our content for commercial purposes without our written permission.

6.3 You must not use the Hi Padel name, logo or other trade marks without our prior written consent.

7. Third-party links and social media

7.1 The Website may contain links to third-party websites and resources, including our social media pages on LinkedIn and Instagram and the websites of our partners. These links are provided for convenience only.

7.2 We have no control over the content of third-party websites and accept no responsibility for them or for any loss arising from your use of them. Your use of third-party websites is subject to their own terms and privacy policies.

7.3 You may link to our home page, provided you do so fairly and legally and do not suggest any association, approval or endorsement by us where none exists. We may withdraw this permission at any time.

8. Our liability

8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

8.2 Subject to clause 8.1, to the fullest extent permitted by law, we exclude all conditions, warranties and representations, express or implied, that may apply to the Website or its content.

8.3 Subject to clause 8.1, we will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss or damage arising from or in connection with:

  • Your use of, or inability to use, the Website.

  • Your reliance on any content on the Website.

  • Any virus or other harmful material that infects your device or data through your use of the Website or any linked website.

8.4 If you use the Website on behalf of a business, school or other organisation, we will not in any event be liable for any loss of profits, revenue, business, opportunity, goodwill or anticipated savings, or for any indirect or consequential loss.

9. Privacy and cookies

9.1 We process any personal data you provide through the Website, including enquiry and partnership form submissions, in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR and the Data Protection Act 2018.

9.2 The Website may use cookies and similar technologies, including for analytics. Where required by law, we will ask for your consent before setting non-essential cookies. Further details are set out in our Privacy Policy.

10. General

10.1 Changes to these Terms. We may update these Terms from time to time. The version published on the Website at the time you use it will apply, so please check this page regularly.

10.2 Severability. If any part of these Terms is found to be invalid or unenforceable, the rest will continue in full force and effect.

10.3 No waiver. If we do not enforce any of our rights under these Terms, that will not prevent us from doing so later.

10.4 Governing law and jurisdiction. These Terms, and any dispute or claim arising out of or in connection with them or the Website, are governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.

10.5 Contact us. Questions about these Terms can be sent to hello@hipadel.co.uk.
